San Jose Apartment Rent Ordinance
The San Jose Municipal Code regulates rent increases for apartments in the City of San Jose. The Apartment Rent Ordinance (ARO) applies to rental units in buildings with 3 or more units that were built and occupied before 1979.
The maximum allowable rent increase for properties controlled by the ARO is 5% in a 12-month period.

Landlords of properties controlled by the Ordinance must:
- Include an Addendum in their Lease Agreement disclosing to Tenants that the rental unit is regulated by the Apartment Rent Ordinance;
- Provide Tenants with a copy of the City of San Jose Apartment Rent Ordinance Notice; and
- Provide Tenants with a copy of the Tenant Protection Ordinance.
